A request for $1.9million in workers compensation by a former Qld miner has been rejected by a Rockhampton court which instead awarded the man $290,000.
Timothy James Klein injured his back at the North Goonyella coal mine in Central Queensland while in the employ of SBD Services in February 2009, the ABC reported.
Klein told a Rockhampton court he felt an ‘explosion of pain’ in his lower back when he attempted to move a rack bar that was claimed to weigh 180 kg.
However in rejecting Klein’s claim for $1.9 million, Justice Duncan McMeekin said the weight of the rack bar was a subject of debate. Justice McMeekin also expressed the opinion that Klein had only suffered six per cent permanent damage and would be capable of finding suitable work in the future.
